JUSTICE SUDHIR SINGH ORAL ORDER 29-07-2015 The petitioner is apprehending his arrest in connection with Mohania P.S. Case No. 88 of 2015 for the offences instituted under Sections 147, 148, 149, 323, 353, 435, 338, 337, 332, 333, 436, 307, 427, 448, 341, 342, 504 of the IPC and 27 of the Arms Act.

Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that the petitioner and others were leading an irate mob of 400-500 persons as one teacher was assaulted by some criminals in the market resulted into his death, the irate mob led by the petitioner blocked the road, ransacked Mohania Police Station and set fire to police vehicles and 3 seized vehicles seized by the police parked inside and outside the police station and by ransacking damaged other

Patna High Court Cr.Misc. No.29574 of 2015 (2) dt.29-07-2015 2/2 vehicles also, resorted to firing and also pelted stones to the police personnel.

It has been submitted on behalf of the petitioner that there is general and omnibus allegation against the petitioner. It is further submitted that altogether 400-500 persons have assembled at the place of occurrence. It is further submitted that no specific injury has been attributed. Other co-accused have been granted bail vide Cr. Misc. No. 19408 of 2015.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Mohania P.S. Case No. 88 of 2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhabua, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
