The petitioner seeks bail in a case registered for the offence under Section 363A / 366 of the Indian Penal Code and Section 8 of the POCSO Act.

It is submitted on behalf of petitioner that the victim girl, in her statement recorded under Section 164 Cr.P.C., has not made any allegation against this petitioner and stated that out of her own will, she left the house with co-accused Dipu Vishwas and solemnised marriage with him. She also disclosed her age to be 18 years. Petitioner has got clean antecedent and he is in custody since 04.07.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances as

Patna High Court CR. MISC. No.94 of 2022(2) dt.10-03-2022 2/2 well as statement of the victim recorded under Section 164 Cr.P.C., the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 7th cum Special Judge, POCSO, Bettiah, West Champaran in connection with Chautarwa (Bathwariya) P.S. Case No. 51 of 2021.
