ANJANA MISHRA ORAL ORDER 10-08-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Bihariganj P.S. Case No.02 of 2017 for allegedly having committed the offence under Sections 414, 420 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that a motorcycle was apprehended which was wanting in documents and, therefore, the same was seized and kept with the police. The petitioner was one of the pillion riders of the motorcycle whose name has been recorded in the Sanha, which was registered. Subsequently, it transpired that the motorcycle was having no valid papers. Thus, the petitioner is

Learned counsel for the petitioner submits that save and except the fact that the petitioner was a pillion rider of the motorcycle, there is no allegation against him. Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedents, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shree Abhimanu Kumar, Judicial Magistrate, 1st Class, Udakishunganj, District-Madhepura, in connection with Bihariganj P.S. Case No.02 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
