The petitioner seeks bail in connection with a case registered for the offence punishable u/s 392 of the IPC. 3.

Allegedly some unknown miscreants are said to have assaulted the informant and looted his money. 4.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence as alleged in the FIR. He has been falsely implicated in this case due to ulterior motive. He is not named in the FIR nor apprehended on the spot. His name transpired in this case on the confessional statement of the apprehended co-accused. No incriminating article has been recovered from the conscious physical possession of the petitioner. Patna High Court CR. MISC. No.69745 of 2024(2) dt.18-10-2024 2/2 criminal antecedent and has been languishing in custody since 18.04.2024. Similarly situated co-accused namely Mohit Kumar has been granted regular bail by a co-ordinate Bench of this Court vide order passed in Cr. Misc. No.14886/2024 dated 12.03.2024.

Learned APP for the State opposed the prayer for bail. 6.

Considering the facts and circumstances of this case, since similarly situated co-accused has been granted bail, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/the Successor Court, in connection with Ghorasahan P.S. Case No.678 of 2023, with the following condition:- (i) Petitioner will mark his attendance at the Ghorashan Police Station, East Champaran on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
