ANJANA MISHRA ORAL ORDER 24-08-2015 Heard learned counsel for the petitioner, learned Additional Public Prosecutor for the State and learned counsel appearing for the informant.

The petitioner apprehends his arrest in connection with C.R. Case No. 1460 of 2013 registered under Section-498(A) of the Indian Penal Code. Learned counsel for the petitioner submits that though the present allegation has been made by the complainant regarding her ill treatment and mental torture, learned counsel for the petitioner submits that the petitioner is willing to make amends and shall not subject her to any act of torture or prejudice her in any manner, if she comes back to him and lives in her matrimonial home. Learned counsel for the informant is

Patna High Court Cr.Misc. No.33229 of 2015 (2) dt.24-08-2015 2/2 apprehensive that once again, if she will go to her matrimonial home, she may be ill treated. However, learned counsel for the petitioner submits that the petitioner is only willing and eager to keep her and undertakes that if she comes to her matrimonial home, no untoward act will be done to her in any manner.

Considering the bona fide of the petitioner and agreed upon by the learned counsel for the informant who has submitted that she is willing to go to her matrimonial home, let the petitioner named above, in the event of his arrest or surrender within three weeks from the date of receipt/production of a copy of the order, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with C.R. Case No. 1460 of 2013 to the satisfaction of Learned Sub Divisional Judicial Magistrate, Darbhanga.

It is made clear that if at all there is any recurrence of untoward act, so as to prejudice the complainant in any manner, it will be open to her to move this court for proper action.
