The petitioner seeks the privilege of pre-arrest bail in connection with Bibhutipur P.S. case No. 19 of 2009 for the offences punishable under Sections 328,302,201/34 I.P.C. At the very out set, it is submitted that in this case the police after completing investigation submitted Final Form against the petitioner showing him innocent and charge sheet has been submitted only against accused Laulim Paswan, vide charge sheet No. 30/2010 dated 4.2.2010, but the learned court below after differing with the police view has taken cognizance against the petitioner also resulting he is apprehending arrest. Learned A.P.P. fairly submits that against the petitioner Final Form has been submitted.

No.31257 of 2014 (3) dt.30-01-2015 2 / 2 In the facts and circumstances as stated above, the above named petitioner in case of his arrest or surrender within two months from the date of receipt/production of a copy of this order shall be released on bail on execution of a bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Rosera at Samastipur in connection with Bibhutipur P.S.Case No. 19 of 2009, subject to the conditions as laid down under Section 438(2) Cr.P.C.
