JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 19-09-2017 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor representing the State of Bihar. This application, for grant of anticipatory bail, arises out of Hajipur Town Police Station Case No. 206 of 2017, disclosing offences under Sections 341/323/504/506/448/380/ 308/34 of the Indian Penal Code.
Learned Counsel for the petitioner has submitted that it is evident from the First Information Report that because of some dispute between the accused persons and the son of the informant, some occurrence had taken place. It is being contended that though there is allegation against the petitioner of having assaulted the informant on his head with an iron-rod, there is absolutely no material suggestive of the fact that the

Considering the submissions as above, this application is allowed.
Let the petitioner, Md. Salim @ Sheru @ Salim, in the event of his arrest or surrender before the Court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali, at Hajipur, in connection with Hajipur Town Police Station Case No. 206 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure, 1973.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court below on two consecutive occasions, his bail bond shall be liable to be cancelled.
