Petitioner apprehends arrest in connection with Complaint Case No. 795 of 2017 registered for the offence punishable under sections 420, 467, 468 of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case due to previous enmity. Petitioner has not taken any money from the informant and his forged signatures have been made on agreement. As a matter of fact, petitioner has filed a complaint case against the present informant as he had taken money from
Patna High Court Cr.Misc. No.75870 of 2018(2) dt.20-12-2018 2/2 this petitioner for execution of sale deed and only to save skin from that case the present false case has been lodged, as would be evident from Annexure-2 and 3. Morevoer, the dispute involved is purely civil in nature for which no criminal prosecution is warranted.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Patna City in connection with Complaint Case No. 795 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C.
