JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 12-03-2015 The petitioners were at the material time in the office of the Bihar State Food and Civil Supplies Godown at Siwan. They apprehend arrest in Siwan(Sadar)Town P.S. Case No. 324 of 2013, instituted under sections 419, 420, 467, 468, 471,120(B) and 409 of the Indian Penal Code.

It is alleged that they, in fact, were receiving payment from the P.D.S. dealers who used to be issued grains . The extent of this defalcation was over rupees twenty eight lakhas. Learned counsel for the petitioners submits that, in fact, it was the dealers who in league with an employee of BSFC, namely, Firozuddin Ahmad used to deposit forged receipt taking it to be genuine release order. Patna High Court Cr.Misc. No.33267 of 2014 (3) dt.12-03-2015 3 / 3 deposited the entire amount and it is on the basis thereof others have already been released on bail. Accountant Ajit Kumar has already been granted anticipatory bail by learned District Judge, Siwan.

Be that as it may, it is directed that in the event of arrest or surrender within four weeks from today, the petitioners Navratan Prasad Sinha and Tribhuwan Nath Singh, shall be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand)each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan, in Siwan Town P.S. Case No. 324/13, subject to the conditions as laid down under section 438(2) Cr.P.C.
