2. For the reasons mentioned in the Interlocutory Application, we are satisfied that the appellants have shown sufficient cause to seek condonation of delay of 121 days in filing the present Letters Patent Appeal.
3. Consequently, Interlocutory Application No. 1730 of 2015 is allowed and delay of 121 days in filing the Letters Patent Appeal is condoned.

2. The order dated 24th of July, 2013 passed by the learned Single Bench of this Court in M.J.C. No. 3745 of 2011 is subject matter of challenge in the present Letters Patent Appeal. The learned Single Bench found that the Secretary, Minor Water Resources Department is guilty of contempt and imposed a cost of Rs. 2,000/- per petitioner.
3. Learned counsel for the appellants contends that the order of punishment is untenable for the reason that the order passed by the learned Single Bench was complied with, though after some delay. Since the order was complied with even before the impugned order was passed, the imposition of costs in these circumstances is harsh and untenable.
4. A perusal of the record shows that an order was passed by this Court on 30th of March, 2011 with a direction which was received in the office of the State on 15.04.2011. The Three Men Committee was constituted on 30th of July, 2011 but the action was not taken within three months of the receipt of the copy of the order on 15.04.2011. The order has been passed on 26th of July, 2012 whereby the direction of the learned Single Bench has been complied

5. Keeping in view the fact that before deciding the Contempt Application, the order was already complied with; we find that the order of imposition of cost is not justified. Therefore, the order holding the Secretary, Minor Water Resources Department guilty of contempt is set aside. Consequently, the order of imposition of cost on him is also set aside.
