Petitioners apprehend their arrest in Ara Town P.S. Case No.522 of 2018, registered under Section 30(a) of Bihar Prohibition and Excise Act, 2016.
The police raided the house of Gautam Singh and arrested two persons, Gautam Singh and Raj Kumar Singh. From the house of Gautam Singh, some bottles of whisky were recovered. Gautam Singh and Raj Kumar Singh disclosed the name of the persons who managed to flee away and they further disclosed that the petitioners and others are also indulged in dealing in country made liquor.
It is submitted that nothing has been recovered from possession of the petitioners. Save and except the statement of Gautam Singh, there is no material on record to show that the

Considering the facts that the petitioners were not arrested on the spot and no material has been collected to show that the petitioners indulged in business of illegal liquor, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of this order be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Bhojpur, Ara in connection with Ara Town P.S. Case No.522 of 2018, subject to the conditions laid down under Section 438(2) Cr. P.C.
