In this case, the petitioner is seeking anticipatory bail in connection with Complaint Case No. 1178C of 2015, registered for the offence punishable under Sections 419, 420, 467, 468, 471 and 120B of the Indian Penal Code. Allegation has been made that the brother of the petitioner has received the land through the gift deed. After his death, his wife and daughters and two minor sons executed the sale deed, but in place of minor sons two different persons appeared at the time of execution of sale deed. Learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.40771 of 2017 (2) dt.21-09-2017 2/2 complainant is nothing to do with the land, in question, inasmuch as, the petitioner is only a deed writer of sale deed. Looking to the facts and circumstances of the case, let the petitioner, namely, Md. Zahid Hussain, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-III, Araria, in connection with Complaint Case No.1178C of 2105, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
