The petitioner seeks anticipatory bail in connection with Gwalpara (Arar) P.S. Case No.103 of 2013 registered under sections 147, 148, 149, 341, 323, 379, 307 and 302 of the Indian Penal Code.
It is contended that though the petitioner is named in the FIR, on completion of investigation the police found him innocent and he was not sent up for trial. However, the learned Magistrate differed with the police report and took cognizance of the offence as against the petitioner.
