The petitioner is apprehending his arrest in connection with Srinagar Pujhan P.S.Case No.09 of 2018 , registered for offences punishable under Sections 341, 323, 354, 504, 506/34 of the Indian Penal Code.
Allegation against the petitioner is that they have misbehaved with the daughter of the informant and when she protested they have assaulted the informant and others. Submission of the learned counsel for the petitioner is that they have been falsely implicated in this case. Heard learned A.P.P. who has opposed the prayer for bail stating that they were on police bail as such this application for anticiatory bail is not maintainable.

No.77813 of 2018(2) dt.03-01-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, surrender before the court below within a period of six weeks from the date of order and prayer for regular bail, which will be considered by the learned court below on the fact that they were on police bail and they have not misused the privilege of the bail and considering the same he will pass appropriate order if possible on the same day.
With the aforesaid observation, this application is disposed of.
