2. This appeal has been filed against the order dated 16.08.2024 passed by learned Special Judge, SC/ST (POA) Act, East Champaran, Motihari in connection with ABP No. 3066 of 2024 arising out of Chhatauni P.S. Case No. 255 of 2024, registered under Sections 341, 323, 448, 354, 379, 504, 506/34

Patna High Court CR. APP (SJ) No.4297 of 2024(4) dt.19-11-2025 2/3 of the Indian Penal Code and Sections 3(i)(r)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, whereby the prayer for anticipatory bail of appellants has been rejected.

3. Prosecution case, in brief, is that on 19.06.24 at about 5:30 PM to 6 PM, when informant, who is posted as field officer is Shubh Laxmi Finance Pvt. Ltd., came from field to her room to take rest, in the meantime, these appellants along with one unknown accused came into her room, dragged her in the hall, assaulted her, abused her by caste name and took away Rs. 19,556/-.

4. It is submitted on behalf of appellants that appellants are innocent and have committed no offence. As per F.I.R., alleged incident took place inside the house of the informant and not within public view as such, no offence under SC/ST Act is made out. Rest of the allegations are ornamental only to make the case grave. Appellants claim clean antecedent.

5. However, learned Spl. Public Prosecutor appearing for the State as well as learned counsel for the respondent no. 2 vehemently opposed the bail application. As a matter of fact, appellant no. 1 was working in the said company as Field Officer and she was replaced and removed by the company due

6. Considering the nature and seriousness of accusation, I do not find any ground to interfere with the order of the learned court below and as such, the appeal, which has been filed for grant of anticipatory bail, is hereby rejected. (Prabhat Kumar Singh, J) Navya/- U T
