The petitioner seeks bail in a case registered under Section 414 of the Indian Penal Code and Sections 25(1-B)a, 26, 35 of Arms Act.

Allegation is that one motorcycle, one country made pistol along with seven live cartridges are recovered. It has been submitted on behalf of the petitioner that the petitioner is in custody since 24.05.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. It is alleged that one motorcycle, one country made pistol along with seven live cartridges are said to have been recovered. The petitioner had no knowledge that the

Patna High Court CR. MISC. No.58602 of 2019(2) dt.17-09-2019 2/2 motorcycle in question is stolen property. There is no compliance of Section 100 of Cr.P.C.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Phulwaria P.S. case No.89 of 2019.
