JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-01-2019 Petitioners apprehend their arrest in connection with Excise Case No. 279 of 2018, arising out of Karandey P.S.Case No. 39 of 2018 registered for the offences punishable under Sections 272, 273, 188 of the Indian Penal Code and Section 30(d) of Bihar Prohibition and Excise Act.

Allegation is of recovery of 20 litres of liquor from the west side of 'Bathan' of the petitioners. Submission of learned counsel for the petitioners is that no recovery has been made from their conscious possession or from their house and they have no criminal antecedent and they are ready to abide by any condition that may be imposed on them.

Heard learned APP also.

No.77638 of 2018(2) dt.02-01-2019 2/2 Having heard both sides and in the facts and circumstances, let petitioners, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of 1st Additional District and Sessions Judge, Sheikhpura, in connection with Excise Case No. 279 of 2018, arising out of Karandey P.S.Case No. 39 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioners shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
