JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but in course of investigation, one Ramanand Paswan was arrested by the police in another case and his confessional statement was recorded. The aforesaid co-accused Ramanand Paswan disclosed the name of petitioner and others and on the basis of his confessional statement, looted mobile was recovered from possession of the co-accused Rahul Kumar Mandal. Admittedly, nothing has been recovered from conscious possession of the petitioner and except the aforesaid confessional statement and some criminal antecedent, there is nothing against the petitioner, who is languishing in jail custody

Patna High Court Cr.Misc. No.28973 of 2016 (3) dt.26-07-2016 2/2 since 09.02.2016.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga in connection with Darbhanga Town P.S.Case No. 11 of 2016.
