The petitioner seeks anticipatory bail in Chandi P.S. Case No.174 of 2016 instituted for the offences under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act. From the First information Report and case diary it appears that it is completely a political murder of the elected Mukhiya. The rival group hatched a plan and caused fire armed injury to the wife of the informant.

From statement of the main accused it appears gun which was used, was recovered from his possession and ballistic report reflects that gun which was recovered from the possession of the petitioner was used in the said incident.

Patna High Court Cr.Misc. No.24036 of 2017 (3) dt.25-08-2017 In such view of the matter, this Court is not inclined to enlarge the petitioner on anticipatory bail. Accordingly the prayer for bail is rejected.
