The petitioner apprehends his arrest in connection with Budha Colony P.S. Case No. 120 of 2019, registered for the offence punishable under Section 420/ 406/ 467/ 468/ 471 of the Indian Penal Code.
The allegation against the petitioner is that the petitioner entered into an agreement with the informant for sale of a piece of land bearing Khata No. 16, Kheshra No. 518, Tauzi No. 5225 situated at Budha Colony in the year 2013, but despite payment of entire amount, sale deed was not being executed by the petitioner.
A joint affidavit has been filed on behalf of both the
Patna High Court CR. MISC. No.58328 of 2019(3) dt.20-11-2019 2/2 parties and in paragraph no. 3 of the same it has been stated that the informant has now no claim, much less, any financial claim, against the accused -petitioner.
Having regard to the submissions made by learned counsel for the parties and taking into consideration the fact that both the parties have settled their dispute amicably out of court, I am inclined to grant the privilege of anticipatory bail to the petitioner.
Accordingly, the order dated 16.09.2019 whereby provisional anticipatory bail was granted to the above named petitioner is hereby confirmed.
