No. 88 of 2017 Both the interlocutory applications are an application under Order 23 Rule 3 of the C.P.C. on behalf of both the parties praying therein to accept the compromise petition. The compromise petition is signed by all the parties and in support of the compromise the parties have sworn affidavits also both the learned counsels are present and support the factum of compromise. It is submitted that in view of the compromise now both the parties do not want to contest this appeal and the appeal be disposed of in terms of compromise.

I.A. No. 87 of 2017 and 88 of 2017 are the same but as respondent no.3 Sobha Devi has not filed affidavit earlier and, as such, her affidavit has been filed along with I.A. No. 88 of 2017.

Patna High Court FA No.335 of 2013(113) dt.11-04-2018 2/2 Perused the interlocutory applications, which is compromise petition, the compromise petition is in order.
