JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State.

Petitioner is in jail custody since 20.03.2014 in a case registered for the offences punishable under Section 302 and other minor sections of the Indian Penal Code.

Taking into consideration that there is specific allegation against this petitioner that he gave lathi blow on the head of the deceased and the aforesaid allegation appears to be corroborated by the post mortem report of the deceased, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Udwant Nagar P.S. Case No. 67 of 2014 pending in the court of Chief Judicial Magistrate, Bhojpur, Ara stands rejected.
