Petitioners apprehend arrest in Rupaspur PS Case No. 376 of 2018 registered under Sections 363, 366(A)/34 and 376 of the IPC.
It is submitted that specific allegation of abduction , as emanating from the statement of the victim girl recorded under Section 164 Cr.P.C. (Annexure 3), is against Lal Babu Paswan (co-accused). The petitioners are family members of said Lal Babu Paswan and from the statement of the victim recorded under Section 164 Cr.P.C. it is apparent that no
Patna High Court Cr.Misc. No.75661 of 2018(2) dt.19-12-2018 2/2 allegation whatsoever has been levelled against the petitioners. The petitioners undertake that they will not in any manner influence the victim or other witnesses.
Considering the aforesaid submissions as also the facts and circumstances of the case, prayer for anticipatory bail of the petitioners is allowed. In the event of their arrest or surrender before the court below within four weeks from today, let the petitioners above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of ACJM II, Danapur, Patna in Rupaspur PS Case No. 376 of 2018 subject to all conditions as laid down in Section 438(2) of the Criminal Procedure Code.
