The petitioner is apprehending his arrest in connection with Town P.S.Case No.573 of 2018 registered for offences punishable under Sections 30(a) of Bihar Prohibition and Excise Act, 2016.
Allegation as per FIR is that the police apprehended the co-accused persons and 28 ltrs. of foreign liquor has been recovered from them.
Submission of the learned counsel for the petitioner is that there is no specific allegation of recovery from the petitioner rather he has been named on the basis of confession of the co-accused.
Heard learned A.P.P. also.
Patna High Court Cr.Misc. No.77688 of 2018(2) dt.02-01-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court. With the aforesaid observation, this application is dismissed.
