2. In this case, the petitioner is seeking regular bail in connection with Madhepura P.S. Case No. 1082 of 2023, registered for the offences punishable under Sections 457, 380 and 411of the Indian Penal Code.

3. As per allegation, the informant and his family members went out of the house. The accused persons including the petitioner entered into the house of the informant and stolen some ornaments and Rs. 25,000/- cash.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Nothing was recovered from the possession of the petitioner. He further submitted that the petitioner was not arrested at the spot

Patna High Court CR. MISC. No.64729 of 2024(2) dt.18-09-2024 2/2 and except the confessional statement, there is nothing against the petitioner. He is under custody since 17.12.2023.

5. On the other hand, learned APP for the State opposes the prayer for bail of the petitioner.

6. Considering the above-mentioned facts and circumstances, the petitioner, above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Madhepura in connection with Madhepura P.S. Case No. 1082 of 2023, subject to the following condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
