JUSTICE JYOTI SARAN ORAL ORDER 05-02-2016 Learned counsel for the petitioner, learned counsel for the State and Mr. J.P. Karn for the Union of India have been heard.

Grievance of the petitioner who retired as Panchyat Sewak from Araria Block, District-Araria on 31.1.2013 is that although in compliance of the directives of the Block Development Officer, Araria dated 12.1.2013 present at Annexure-2, he has submitted his papers but a period of almost three years having passed since his retirement, he has not received any retiral benefits.

Having heard learned counsel for the parties and

Patna High Court CWJC No.16219 of 2014 (3) dt.05-02-2016 considering the nature of grievance raised herein, instead of keeping the writ petition pending, I deem fit and proper to direct the Block Development Officer, Araria to take all appropriate steps for payment of the retiral benefits of the petitioner which remains pending since last three years, if not already paid. The pension papers along with the authorization if not already sent to the Accountant General by the authority concerned should be forwarded within two weeks from the date of receipt / production of a copy of the order and the Accountant General would be under obligation to pass appropriate orders on the same within two weeks thereafter, following which steps be taken for the payment within four weeks thereafter. In case any of the claims is found not admissible then the same should be disposed of by a speaking order to be passed within a period of three months of receipt / production of a copy of this order.

The writ petition is disposed of.
