JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-09-2019 This is an application for grant of anticipatory bail in connection with Sathi P. S. Case No. 57 of 2019, disclosing offences under Sections 341, 323, 498A, 504, 506, 34 of IPC. Allegation against the petitioner, who happens to be the husband of the informant, having illicit relationship with a married lady and for that reason, he started assaulting her and lastly ousted her from the house.

Submission of the learned counsel for the petitioner is that the allegation is false and concocted. He is still ready to keep her with dignity and care and even marriage was solemnized 14 years ago.

Having heard both sides, considering the above

Patna High Court CR. MISC. No.58587 of 2019(2) dt.17-09-2019 2/2 submissions, let the petitioner, above named, surrender before the court below within a period of two weeks from the date of receipt of certified copy of this order, on surrender, he will be released on provisional bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Bettiah, District West Champaran, in connection with Sathi P. S. Case No. 57 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.

In the meantime, the learned court below issue notice to the opposite party no.2 and once she appeared and so desires to reside with the petitioner, the petitioner has to keep her with dignity and care, otherwise, his bail bonds shall be cacncelled. (Vinod Kumar Sinha, J) Sunil Shukla/- U T
