12-07-2016 Heard Sri Ritesh Kumar Singh, learned counsel for petitioners and Sri Anant Kumar, learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 15-12-2015, as stated in paragraph - 15 of the petition, has prayed for grant of bail in Sultanganj P.S. Case No. 229 of 2015, G.R. No. 4003 of 2015 registered for the offence under Section 392 of the Indian Penal Code.

It was submitted by learned counsel for the petitioner that save and except confessional statement of accused, there is nothing to implicate the petitioner. He further submits that almost in similar circumstances, two accused persons namely Santosh Kumar Mandal and Gabbar Mahto @ Ajai Kumar @ Ajai Mahto have been granted bail by this Court, vide Cr. Misc. No. 12907 of

Patna High Court Cr.Misc. No.26694 of 2016 (3) dt.12-07-2016 2/2 2016 and Cr. Misc. No. 21607 of 2016 respectively, whereas, Sri Anant Kumar, learned Addl. Public Prosecutor opposing the prayer for bail submits that as per Annexure - 2, some looted currency notes were recovered from the possession of the petitioner.

Be that as it may, keeping in view the fact that petitioner has been made accused only on the basis of confessional statement as well as the fact that other two accused persons, almost in similar circumstances, have already been extended the privilege of bail, there is no reason to refuse the prayer for bail of petitioner.

Accordingly, let the petitioner namely Shekhar Ravi Das be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in Sultanganj P.S. Case No. 229 of 2015.
