2. The petitioner apprehends his arrest in a case in connection with Barharia P.S. Case No. 111 of 2023, registered for the offences punishable under Sections 304B/34 of the Indian Penal Code, 2016.
3. As per F.I.R., allegation against the petitioner is of killing his wife.
4. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case. Petitioner has got no criminal antecedent mentioned in
Patna High Court CR. MISC. No.64629 of 2023(3) dt.19-01-2024 2/3 Para 3 of the bail application. He further submits that the petitioner is the husband of the deceased (Khusboo Verma) and she is suffering from Hepatic Granuloma which indicates that the deceased not conceived therefore she gone to depression and committed suicide. He further submits that when the deceased has committed suicide petitioner was not at the place of occurrence rather he was at Bombay for business work. He further submits that petitioner did the last rituals of his wife as per Hindu rites and informant and his family members were also participated in the rituals.
5. Learned APP for the State and learned counsel for the informant have opposes the prayer for bail and submits that within one year of marriage of informant sister, she died in the matrimonial home and petitioner is the husband who did not care his wife.
6. Having regard to the facts and circumstances of the case and also considering the medical report of the deceased, let the above named petitioner, be released on bail, in the event of his arrest, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending/ successor Court in connection with Barharia P.S. Case
