JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 302 and 384/34 of the Indian Penal Code and Section 27 of the Arms Act. The prosecution case is that co-accused Chandra Shekhar Paswan, Bucho Paswan, Baijnath Paswan and this petitioner came to the betel shop of the brother of the informant when Chandrashekhar Paswan asked the brother of the informant that why the demanded extortion money was not paid and on refusal by the brother of the informant, on the order of co-accused Baidnath Paswan, Chandrashekhar Paswan shot the brother of the informant who subsequently succumbed to the injuries. It is submitted by learned counsel for the petitioner that no specific overt act has been alleged against the petitioner. Rinku

Patna High Court Cr.Misc. No.34309 of 2015 (3) dt.03-09-2015 2/2 Devi, wife of Pappu Kumar Paswan who is the brother of the petitioner lodged a case in the year 2012 against the victim levelling accusation under Sections 323, 341, 354, 452, 448, 380, 384 and 506 of the IPC wherein the father of the petitioner deposed as a witness, hence the petitioner has been roped in the present case. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the fact that no overt act has been alleged against the petitioner, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Begusarai in connection with Gadhpura P.S. Case No. 91 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
