Mr. SMT. MADHURI LATA ====================================================== CORAM: HONOURABLE MR. JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 19-09-2017 Heard learned counsel for the petitioners and learned APP representing the State.

The petitioners apprehend their arrest in connection with Daniyawa P. S. Case No. 12 of 2016 registered for the offences punishable under Sections 341, 323, 504, 353, 307/34 of the Indian Penal Code.

Allegedly, the petitioners were caught when they were assaulting the men of Jai Kishan Hotel and thereafter, the petitioners started assaulting the informant, a police officer, with belt causing some injury, however, with the help of other police personnel they were apprehended and remanded in custody in case related with the incident of Hotel.

Submission is of false implication and that after lodging of that case the Police falsely implicated the petitioners in this case

Patna High Court Cr.Misc. No.44109 of 2017(2) dt.19-09-2017 2/2 also but they did not remand the petitioners in this case and after getting bail in that case they are being searched for their arrest and as such the petitioners deserve sympathetic consideration. Learned APP fairly submits that the petitioners were remanded to custody in Daniyawa P. S. Case No. 11 of 2016 wherein the petitioners have been allowed bail by the learned Judicial Magistrate itself on the basis of compromise arrived at between the parties but surprisingly the petitioners were not remanded in this case.

In the facts and circumstances stated above, the petitioners above named, in case of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order, are directed to be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Md. Jamil, J. M. Patna in connection with Daniyawa P. S. Case No. 12 of 2016, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
