The petitioner is apprehending arrest in a case registered for the offences punishable under sections 379 and 411 of the Indian Penal Code.

The informant's Herohonda motorcycle was stolen leading to registration of FIR against unknown. Subsequently, the Herohonda motorcycle was recovered from the house of Md. Mintu, accused in Tarapur P.S Case No. 62 of 2014. Md. Mintu disclosed the name of the petitioner and described how the motorcycle in question was stolen.

It is submitted by the learned counsel for the petitioner that admittedly the recovery was not made from the

Patna High Court Cr.Misc. No.23217 of 2016 (2) dt.24-05-2016 2/2 petitioner but only on confession of co accused, the petitioner has been roped in the present case. The petitioner is accused in two other cases of similar nature but he is on bail in those cases. Statement to that effect has been made in paragraph 3 of the petition.

Considering the fact that recovery has not been made from the petitioner, it is a case for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Kharagpur P.S. Case No. 126 of 2014 pending in the court of learned SDJM, Munger.

This application is disposed of with the aforesaid observation/direction.
