1. Heard the parties.

2. The petitioner apprehends his arrest in connection with Complaint Case No. 1144C of 2024 instituted for the offence punishable under Sections 115(2), 126(2), 127(2), 109, 303, 85, 3(5) of the B.N.S. 2023.

3. As per the allegation made in the complaint marriage of the complainant was performed with the petitioner on 01.06.2023 and it is alleged that the petitioner and other family members harassed the complainant due to non fulfillment of demand of 'Apache' motorcycle in dowry. It is further alleged that the petitioner has illicit relation with one Rani Devi i.e. elder 'gotani' of the complainant.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case by the complainant to pressurize him. He further submits that the fact of the matter is that after 'Bidai' when the complainant came to her matrimonial home she used to talk with one boy Sonu Sah with whom she was having love affair from before which was not to the liking of her in-laws' family members and due to that altercation took place.

Learned counsel next submits that the case was sent for mediation by this Court vide order dated 17.12.2025 and in the mediation between the husband and wife the case has been compromised and final mediation report has been prepared and signed by both petitioner and the Opposite Party No. 2 on 09.02.2026.

6. Learned counsel for the O.P. No. 2 supports the argument of learned counsel for the petitioner regarding amicable settlement arrived at between the parties through the process of mediation.

7. Considering the fact that the matter has been compromised between husband and the wife and mediation report has been submitted by the learned Mediator having the terms and conditions of compromise, I am inclined to grant the

Patna High Court CR. MISC. No.62680 of 2025(5) dt.23-02-2026 3/3 petitioner privilege of anticipatory bail subject to the condition that the petitioner shall strictly abide by the terms and conditions of compromise mentioned in the mediation report dated 09.02.2026.

8. Let the petitioner, above named, in the event of his arrest / surrender before the learned court below within a period of six weeks from today be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Miss Amrita Nupur, learned Judicial Magistrate- Ist Class, Bhojpur at Ara in connection with Complaint Case No. 1144C of 2024 subject to the condition as laid down under Section 482(2) of the B.N.S.S.
