In this case, the petitioner is seeking anticipatory bail in connection with Nautan P.S. Case No.314 of 2018, registered for the offence punishable under Sections 30(A) / 36 of Bihar Prohibition and Excise Act.

Allegation has been made that the police has seized huge quantity of illegal liquor. The name of the petitioner has come during the investigation.

Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected.

However, if the petitioner surrenders before the Court below within four weeks from today and prays for regular bail,

Patna High Court Cr.Misc. No.118 of 2019(2) dt.10-01-2019 2/2 the Court below will consider the same and pass appropriate order on the same day without being influenced by the order of this Court.
