JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-01-2019 This is an application for grant of anticipatory bail in connection with Amarpur P.S. Case No. 55 of 2018, disclosing offences under Sections 341, 323, 498(A)/34 of the Indian Penal Code and Section 3/4 of the D.P. Act.
Allegation against the petitioner, who happens to be the husband of the informant, is of demand of dowry of Rs.1,00,000/- and motorcycle and also allegation of torturing the informant.
Submission of learned counsel for the petitioner is that the informant herself left the house of the petitioner, which will appear from the complaint petition itself and there is delay of about two months in lodging the F.I.R.. Further the petitioner is still ready to keep the informant with full respect and dignity. Heard learned A.P.P. also.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Banka, in connection with Amarpur P.S. Case No. 55 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
This is further subject to the condition that if any case for maintenance is being filed by the informant, the petitioner shall cooperate in the said maintenance case, otherwise the informant will be free to move for cancellation of the bail bonds of the petitioner before the learned court below itself.
