JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-05-2016 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 308, 504, 34 of the Indian Penal Code. The prosecution case is that on 06.09.2015 at 6:30 A.M petitioner No. 3 Raju Ram and co-accused Subash Ram came to the house of the informant and started abusing the daughter of the informant. On protest being made coaccused Subash Ram caused injury on the head of the informant by means of axe and when the informant fell down then petitioner Nos. 1 and 2 assaulted the informant with lathi. During the course of occurrence the wife and daughter of the informant were also assaulted.
It is submitted by learned counsel for the petitioners that injury report of the informant suggests only one
Patna High Court Cr.Misc. No.22451 of 2016 (2) dt.19-05-2016 2/2 sharp cut injury which is attributed to co-accused Subash Ram. Petitioner Nos. 1 and 2 are ladies and there is no specific accusation against petitioner No. 3.
A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Saran at Chapra in connection with Revilganj P.S. Case No. 155 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
