The petitioner seeks bail in a case registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.
The informant is not an eye witness of the occurrence. The informant suspected that the petitioner and other accused persons were talking among themselves to kill the deceased Raghav Rai. The dead body of the deceased was recovered. Except suspicion no material is collected during the course of investigation.
Learned counsel for the informant as well as the learned APP however opposed the prayer for bail and submitted that there is strong suspicion as the petitioner and others were running after
Patna High Court Cr.Misc. No.31168 of 2015 (2) dt.18-08-2015 2/2 the life of Raghav Rai.
Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, Sikrahana at Motihari, East Chamapran in Madhuban P.S. Case No. 302 of 2014.
