The petitioners apprehend their arrest in Baheri P.S. Case No. 45/2015, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The informant alleged that petitioners and others came to his shop and asked to provide food without payment of price. On refusal, the petitioner Ram Vilas Mahato called his brother and they all ransacked his shop. Shyam Kishore Mahato assaulted his father with the butt of the pistol and undressed his mother. The father of the informant was referred to DMCH, Darbhanga for treatment.

Patna High Court Cr.Misc. No.31255 of 2015 (3) dt.13-10-2015 2/2 It is submitted that the petitioner Ram Vilas Mahato also lodged Dehri P.S. Case No. 46/2015 and alleged that the informant and his father are running a shop in his house and when he asked them to vacate the house Binod Kumar Mahato, his father and others assaulted Ram Vilas Mahato and others. There is specific allegation of assault against the petitioners. The father of the informant got simple injuries and the same appears from Annexure-4. The petitioners Ram Vilas Mahato, Shyam Kishore Mahato and his mother Kishni Devi also got injuries.

Considering the facts aforesaid, the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Baheri P.S. Case No. 45/2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
