JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 24-05-2016 Heard learned counsel for the petitioner and the learned Additional Public Prosecutor, appearing on behalf of the State. This application for grant of regular bail arises out of Sultanganj P.S.Case No. 242/2015, disclosing offences under sections 147, 148, 149, 353, 307 of the Indian Penal Code and section 27 of the Arms Act.
The petitioner and other accused persons were arrested by the police after police had received a secret information that they had assembled for the purpose of committing dacoity. Upon seeing the police party they are said to have tried to flee away. They also resorted to firing on police party and thereafter concealed themselves in a cottage. The police party after surrounding the cottage apprehended them including this petitioner. From paragraph 3 of the application, it appears that the
Patna High Court Cr.Misc. No.22954 of 2016 (2) dt.24-05-2016 petitioner has criminal antecedent.
Learned counsel for the petitioner has placed before me an order of this Court dated 11.5.2016 passed in Cr.Misc.No. 19687/2016, whereby a co-accused Vineet Yadav has been granted regular bail by this court. Vineet Yadav was not one, who was arrested at the spot. The case of the petitioner is clearly distinguishable from the case of the said Vineet Yadav. I do not find this to be a fit case for grant of regular bail. This application is, accordingly, rejected.
