The petitioner seeks bail in a case registered under Sections 376(d), 506 of the Indian Penal Code. Earlier prayer for bail of the petitioner was rejected vide Annexure-1 to the present application with observation "At this stage". In pursuance to the said observation, the present application has been filed by the petitioner. Allegation against the petitioner is that in the name of providing job, he took away the informant to Bihta and forcibly committed illegal act with her.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The

Patna High Court CR. MISC. No.58630 of 2019(3) dt.04-12-2019 2/2 petitioner is in custody since 12-08-2018. Charge sheet has already been submitted. Charge has been framed in this case. The victim has been examined during trial. Her deposition is Annexure-3 to the present application. In her examination-inchief, she has not alleged any allegation of commission of rape against the petitioner. She has denied to identify the petitioner in Dock.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the deposition of the petitioner during trial, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-Ist, Patna in connection with Bihta P.S. Case No. 898 of 2018 corresponding to Sessions Trial No. 715 of 2019.
