1. Heard learned counsel for the petitioner and learned APP for the State.

2. The learned counsel for the petitioner submits that petitioner was granted the privilege of anticipatory bail by order dated 02.08.2023 in Cr. Misc. No.40066 of 2023 and the petitioner was directed to surrender within a period of six weeks.

3. The learned counsel for the petitioner submits that during pendency of Cr. Misc. No.40066 of 2023, the father of the petitioner died ad the said fact could not be brought to the notice of the learned lawyer, as such, the description of the petitioner in Cr. Misc. No.40066 of 2023 remained the same.

4. It is next submitted that the order dated 02.08.2023 in Cr. Misc. No.40066 of 2023, the description of the petitioner be read as Anirudh Sahani @ Anarudh Sahani, son of Late Gobind Sahani, village- Bairatwa, P. S. Gaunaha, DistrictWest Champaran, instead of Anirudh Sahani @ Anarudh Sahani, son of Gobind Sahani, village- Bairatwa, P. S. Gaunaha, District- West Champaran. It is further submitted that the present modification application was filed before the time of surrendering of the petitioner was lapsing.

5. The order dated 02.08.2023 in Cr. Misc. No.40066 of 2023 is modified to the extent indicated above, in the event, if petitioner surrenders on or before 13.10.2023, his bail bonds shall be accepted on the same terms and conditions.

6. The modification application is allowed.
