JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-12-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in a case registered for the offences punishable under section 414 of the Indian Penal Code and sections 30(a)/35(c) of Bihar Excise Prohibition Act, 2016.

One person was caught while he was carrying Indian made foreign liquor on a motorcycle. The aforesaid apprehended person disclosed that he was going to deliver the seized Indian made foreign liquor to petitioner. It appears that except the aforesaid material, there is nothing against the petitioner. No doubt, prior to institution of the present case, one case of similar nature has been lodged against the petitioner but

Patna High Court Cr.Misc. No.76496 of 2018(2) dt.21-12-2018 2/2 considering the facts and circumstances of the present case as well as submissions of the parties, let petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II Banka in Banka P.S. Case No. 553 of 2018 subject to conditions as laid down under Section 438(2) of the Cr.P.C.
