This application for grant of regular bail arises out of Samastipur Rail P. S. Case No. 42 of 2015 disclosing offence under Sections 379 and 411 of the Indian Penal Code. The petitioner is in custody since 01.09.2015. Learned Counsel for the petitioner has submitted that nothing has been recovered from the possession of the petitioner and he has been implicated merely on the basis of the statement of one Manju Devi, from whose possession a mobile was recovered saying that the said mobile was given by the petitioner. Considering the period of incarceration, this application is allowed.

Patna High Court Cr.Misc. No.23002 of 2016 (2) dt.25-05-2016 Let the petitioner above-named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate, Samastipur in Samastipur Rail P. S. Case No. 42 of 2015.

This is subject to the condition that the petitioner shall present himself before the police/court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
