The petitioner has preferred this application for grant of regular bail in a case registered under sections 414 and 34 of the Indian Penal Code and sections 25(1-B)(a), 26 and 35 of the Arms Act.

As per the prosecution case, on receiving information about the three accused persons being present on the tea stall with arms and ammunitions, it is stated that a raid was conducted and on search arms and ammunitions, knife etc. were recovered. The petitioner was amongst the accused. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case under a misunderstanding. Accepting the allegations in the FIR a live cartridge is said to have been recovered from the possession of

Having heard learned counsel for the parties and taking into consideration the allegations in the FIR together with the petitioner having remained in custody for 9 months and investigation in the case having concluded, the Court directs the petitioner to be enlarged on bail in connection with Tisiauta P.S. Case no. 104 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur.
