Heard the learned counsel for the petitioners and learned APP for the State.
The petitioners apprehend their arrest for the offences alleged under Sections 363, 366(A) and 34 of the Indian Penal Code, registered in connection with Basopatti P.S.Case No. 172 of 2021.
As per allegation, the accused persons enticed away the minor daughter of the informant.
The learned counsel for the petitioners has submitted
Patna High Court CR. MISC. No.96 of 2022(2) dt.01-08-2022 2/2 that the daughter of the informant in her statement recorded under Section 164 of the Cr.P.C. has stated categorically that none had kidnapped her, rather she had gone with her own sweet will and solemnized marriage with petitioner no.1. Learned APP has opposed the prayer for anticipatory bail.
Considering the above facts and circumstances, let the petitioners above-named, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of learned CJM, Madhubani in connection with Basopatti P.S.Case No. 172 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioners within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
