JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2019 This is an application for grant of anticipatory bail in connection with Mirganj P.S. Case No. 297 of 2018, disclosing offences under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Allegation is of recovery of 164 liters liquor from a vehicle and one person was arrested, who disclosed the name of the petitioner. Further, it appears that the petitioner is accused in 8 other cases.

Submission of learned counsel for the petitioner is that nothing has been recovered from the conscious possession of the petitioner and he has has named by the co-accused only on the basis of confessional statement.

Having heard both sides, in view of the above facts

Patna High Court Cr.Misc. No.78629 of 2018(2) dt.10-01-2019 2/2 and circumstances of the case and also considering the criminal antecedents of the petitioner, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which will be considered on its own merit, without being prejudice by order of this Court.
