JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 03-04-2015 Heard learned counsel for the petitioners as well as learned counsel for the State.

In this application for anticipatory bail the petitioners apprehend their arrest for the offences punishable under sections 341, 323, 307 and 504/34 of the I.P.C.

Allegedly, for dues of price of milk altercation took place between brother of the informant and the accused persons and in the meantime co-accused Sunil Ram gave knife blow in the stomach of Md. Shamsad Khan, Anita Devi assaulted with brick causing head injury, Guriya Kumari assaulted with lathi, petitioner no.1 assaulted with brick and petitioner no.2 came with lathi and abused as also assaulted.

Patna High Court Cr.Misc. No.38593 of 2014 (2) dt.03-04-2015 2/2 Submission is of false implication and that there is case and counter case. Three injuries have been found on the brother of the informant for which the petitioners are not responsible. Co-accused Anita Devi has been allowed pre-arrest bail and as such the petitioners deserve sympathetic consideration, to which the learned A.P.P. opposes.

Considering the allegation attributed against the petitioners that they are not responsible for the injuries caused on the person of brother of the informant and as such the petitioners in case of their arrest or surrender within two months from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of. C.J.M. Nalanda at Biharsharif in Rajgir P.S. Case No. 90 of 2014, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
