====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 09-01-2019 Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner is seeking anticipatory bail in connection with Nawada Muffasil P.S. Case No. 170 of 2018, registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

Allegation has been made that from the house having no top roof, the police has recovered 16 liters of country made liquor. Learned counsel for the petitioner submits that it was the joint family house having no top roof.

Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected.

However, if the petitioner surrenders before the Court

Patna High Court Cr.Misc. No.77604 of 2018(2) dt.09-01-2019 2/2 below within a period of weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order on the same day without being influenced by the order of this Court.
