Petitioners apprehend their arrest in connection with Tisiauta P. S. case no. 75/2013 registered under section 307 and other allied sections of the IPC and 27 of the Arms Act. There is specific allegation against petitioner no.1 that he gave farsa blow on the back of the informant and so far as rest petitioners are concerned, there is omnibus allegation of assault against them.

Admittedly, there is counter case i.e. Tisiauta P. S. case no. 74/2013 in which petitioner no.1 is said to have sustained injury. Injury report of the informant of the present case reveals that

No.51822 of 2014 (2) dt.05-01-2015 informant sustained altogether four injuries and out of the aforesaid four injuries, one injury was found on the back of the informant but the aforesaid injury was found simple in nature. Therefore, considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in Tisiauta P. S. case no. 75/2013 subject to condition as laid down under section 438(2) of the Cr.P.C.
