The petitioner apprehends his arrest in Complaint Case No. 1154(C) of 2013 registered for the offences punishable under Section 354 of the Indian Penal Code.
The complainant alleged that while his daughter was sleeping along with the family members on the roof, the petitioner scaled over the roof at 12:00 in the night and after untying her pant the petitioner committed rape with her.
Learned counsel for the petitioner submits that the complainant and the petitioner are close relatives. The complainant has got share in his maternal property for that a title
Patna High Court Cr.Misc. No.25480 of 2016 (3) dt.20-09-2016 2/2 suit is pending. The petitioner is maternal brother of the complainant and on account of this fact this false case has been lodged.
On the other hand, learned counsel for the complainant opposed the prayer for anticipatory bail of the petitioner. It appears that the petitioner is alleged to have tried to outrage the modesty of a minor girl aged about six years, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
